1. Acceptance of Terms
By creating an account or using the Switchr mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.
2. Eligibility
- You must be at least 18 years of age to use Switchr.
- By creating an account, you represent and warrant that you are at least 18 years old.
- Accounts found to belong to users under 18 will be immediately terminated and reported to the appropriate authorities if required by law.
- You must be legally able to enter into a binding agreement in your jurisdiction.
3. Your Account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You may only maintain one Switchr account at a time.
- You must provide accurate information during registration and keep your profile information truthful.
- You may delete your account at any time through the App's Settings.
4. How Switchr Works
Switchr is a dual-mode dating and social app:
- Meaningful Mode: Designed for users seeking meaningful, long-term connections.
- Momentary Mode: Designed for casual interactions and social discovery.
Your activity in one mode is completely separate from the other. Switchr facilitates introductions but does not guarantee any particular outcome. We are not responsible for the behavior of other users.
5. User Conduct
You agree not to:
- Use the App for any illegal purpose or in violation of any applicable laws.
- Harass, threaten, stalk, or intimidate any other user.
- Post or transmit content that is hateful, violent, sexually explicit involving minors, or otherwise objectionable.
- Impersonate any person or entity, or misrepresent your identity, age, or affiliation.
- Upload photos that you do not have the right to share, or that depict other people without their consent.
- Use the App to solicit money, promote commercial products, or engage in spam.
- Attempt to access other users' accounts or data without authorization.
- Use automated systems, bots, scrapers, or other non-human means to access the App.
- Interfere with or disrupt the App's infrastructure or other users' experience.
- Distribute or share child sexual abuse material (CSAM) in any form.
6. Content Ownership & License
- Your Content: You retain ownership of any content you upload (photos, bios, messages). By uploading content, you grant Switchr a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating the App.
- Our Content: The Switchr name, logo, design, and all software are owned by Switchr and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.
- License Termination: When you delete content or your account, our license to that content ends, except where copies have been shared with other users (e.g., messages already delivered) or where retention is required by law.
7. Safety & Reporting
Switchr is committed to user safety:
- You can report any user or content that violates these Terms through the in-app reporting system.
- We review reports and may take action including warnings, temporary suspensions, or permanent bans.
- Reports involving minors or CSAM are escalated immediately and reported to NCMEC and/or law enforcement.
- We reserve the right to remove content and terminate accounts at our sole discretion.
8. Subscriptions & Purchases
8.1 Subscription Plans
Switchr offers an optional Switchr Premium subscription that unlocks additional features including more Sparks, unlimited Momentary Mode profiles, Passport (browse other locations), and an ad-free experience.
Subscription options:
- Monthly Premium: Billed monthly at the price shown in the app at the time of purchase.
- Yearly Premium: Billed annually at the price shown in the app at the time of purchase.
8.2 Auto-Renewal
All subscriptions automatically renew. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. The renewal charge will be applied to your payment method within 24 hours before the end of the current period.
Deleting the app does not cancel your subscription. You must cancel your subscription through your platform's subscription management to stop being charged.
8.3 How to Cancel
You can cancel your subscription at any time:
- On iOS: Go to Settings → [Your Name] → Subscriptions → Switchr → Cancel Subscription, or use the "Manage Subscription" option in the Switchr Settings screen.
- On Android: Go to Google Play Store → Payments & Subscriptions → Subscriptions → Switchr → Cancel Subscription, or use the "Manage Subscription" option in the Switchr Settings screen.
After cancellation, you will retain access to Premium features until the end of your current billing period. Cancellation does not provide a refund for the current period.
8.4 Pricing Changes
We reserve the right to change subscription pricing at any time. If we change pricing:
- Active subscriptions will not be affected until the next renewal after the price change takes effect.
- We will notify you in advance of any price changes via the email associated with your account.
- If you do not agree to the new price, you can cancel your subscription before the renewal date to avoid being charged the new price.
8.5 Refund Policy
Refunds for subscription purchases are handled according to the policies of the platform through which you made the purchase:
- Apple App Store: Refund requests must be submitted through reportaproblem.apple.com. Apple reviews and processes all refunds at their discretion.
- Google Play Store: Refund requests must be submitted through the Google Play refund process. Google reviews and processes all refunds at their discretion.
Switchr does not have the ability to process refunds directly — all subscription payments are handled by Apple and Google.
8.6 Free Trial
Switchr may offer a free trial period for new subscribers. The free trial begins when you subscribe and ends at the end of the trial period shown at sign-up. At the end of the trial period, your subscription will automatically convert to a paid subscription at the then-current price unless you cancel at least 24 hours before the trial ends. Only one free trial is available per user.
9. Termination
- By You: You may delete your account at any time from the App's Settings. Deletion is immediate and permanent.
- By Us: We may suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any reason we deem necessary for the safety of our community.
- Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will do so (including Sections 6, 10, 11, and 12).
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Switchr does not conduct criminal background checks on users. You are solely responsible for your interactions with other users. Always exercise caution and use good judgment when communicating with or meeting anyone through the App.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWITCHR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO SWITCHR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
12. Dispute Resolution
- These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
- Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at legal@switchr.app.
- If informal resolution fails, disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive relief in court for intellectual property violations or safety emergencies.
- You agree to resolve disputes on an individual basis and waive the right to participate in a class action.
13. Indemnification
You agree to indemnify and hold harmless Switchr, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.
14. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you through the App or by updating the "Last Updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
